RELEASE OF LIABILITY - ASSUMPTION OF RISK - READ BEFORE SIGNING.
By signing this waiver, I agree that I am a member of ATX Runners, and I am aware that activities organized by ATX Runners, including but not limited to group runs, track or other workouts, trail runs, happy hours and social events at public or private venues, volunteer activities, carpooling or travelling to and from events and races, and any other ATX Runners-sponsored, ATX Runners-led, or ATX Runners-organized activity (referred to herein as an “ATX Runners Event” or “ATX Runners Events”) are potentially hazardous activities or carry inherent risks, which could cause injury, death or property damage.
ASSUMPTION OF RISK
I agree that I will not participate in any ATX Runners Event, unless I am medically able and properly trained, and by my signature, I certify that I am medically able to perform all activities associated with ATX Runners or an ATX Runners Event and am in good health, and I am properly trained.
ATX Runners reserves the right to deny, suspend, or revoke participation in any ATX Runners Event, or membership in ATX Runners, for safety, conduct, policy violations, or other reason as determined in ATX Runners’ sole discretion.
I assume all risks associated with being a member of ATX Runners and participating in any ATX Runners Event, which may include but are not limited to the risk of injury, illness, property damage, or death related to: falls; contact with other ATX Runner Event participants or any other persons; medical events or conditions whether diagnosed or undiagnosed; the effects of weather, including cold, heat, humidity, and lightning; bicycle or motor- or e-vehicle traffic; and the conditions of roads, sidewalks, or other surfaces including defects and impediments, all such risks being known, appreciated, and assumed by me. I understand that bicycles, skateboards, baby joggers, roller skates or roller blades, animals, and personal music players are strongly discouraged from being used in club organized activities and I agree to abide by this rule. I have read the rules of ATX Runners and agree to abide by them.
I assume the risk of foodborne illnesses that may occur while participating in an ATX Runners Event. I also agree to follow applicable ATX Runner health and safety policies and public health guidance regarding communicable illness, including but not limited to COVID-19.
GENERAL RELEASE
Having read this waiver and knowing these facts and in consideration of your accepting my membership, I, for myself and anyone entitled to act on my behalf, waive and release the ATX Runners, all running groups associated or affiliated with ATX Runners, the Road Runners Club of America, and all ATX Runners sponsors, and each of their respective officers, directors, volunteers, including pace group leaders, social event hosts whether public or private venue, independent contractors, agents, employees, representatives, and successors (the “Released Parties”) from any and all claims, causes of action, or liabilities of any kind, whether for personal or bodily injury, property damage, or both, arising out of my participation with or in ATX Runners or any ATX Runners Event, even if that liability arises out of negligence or carelessness on the part of any of the Released Parties.
INDEMNIFICATION
I, for myself and anyone entitled to act on my behalf, agree to indemnify any of the Released Parties from and against costs, fees, expenses, damages and liabilities (including reasonable attorney’s fees) associated with any third-party claim, loss or damage arising from personal or bodily injury or damage to real and/or tangible personal property caused by me during my participation an an ATX Runners Event.
BINDING EFFECT ON MINOR
For parents/guardians of signing on behalf of a minor: I have adequately explained this document and ATX Runners-related risks to the minor for whom I am signing. The foregoing assumptions of risk, releases, and indemnification obligation, and the photograph and media release below, are binding on the minor on whose behalf I am signing to the same extent as they would be binding on me if I were executing this document on behalf of myself.
PHOTOGRAPH AND MEDIA RELEASE
I hereby grant permission to ATX Runners and its authorized representatives to use photographs, video recordings, audio recordings, or other recordings of me taken during an ATX Runners Event for promotional, educational, or ATX Runners-related purposes, without compensation to me.
ACKNOWLEDGMENT — READ BEFORE SIGNING
I acknowledge and agree that attendance at and participation in any ATX Runners Event is strictly conditioned on signing and returning this document. I knowingly and voluntarily execute this document and agree to be bound by its provisions in perpetuity to the fullest extent permitted by law. ATX Runners may require re-execution of this or a similar document annually.
