PLEASE READ CAREFULLY
WAIVER AND RELEASE OF LIABILITY
In consideration of Choctaw Paintball and Madewell Enterprises, LLC furnishing services and/or equipment to enable me to participate in paintball and or gel blaster games, I agree as follows:
I fully understand and acknowledge that; (a) risks and dangers exist in my use of Paintball or Gel blasters equipment and my participation in those activities; (b) my participation in such activities and/or use of such equipment may result in my injury or illness including but not limited to bodily injury, disease strains, fractures, partial and/or total paralysis, eye injury, blindness, heat stroke, heart attack, death or other ailments that could cause serious disability; (c) these risks and dangers may be caused by the negligence of the owners, employees, officers or agents of Choctaw Paintball the negligence of the participants, the negligence of others, accidents, breaches of contract, the forces of nature or other causes. These risks and dangers may arise from foreseeable or unforeseeable causes; and (d) by my participation in these activities and/or use of equipment, I hereby assume all risks and dangers and all responsibility for any losses and/or damages, whether caused in whole or in part by the negligence or other conduct of the owners, agents, officers, employees of ChoctawPaintball,or by any other person. I, on behalf of myself, my personal representatives and my heirs, hereby voluntarily agree to release, waive, discharge, hold harmless, defend and indemnify Choctaw Paintball and it's owners, agents, officers and employees from any and all claims, actions or losses for bodily injury, property damage, wrongful death, loss of services or otherwise which may arise out of my use of Paintball or Gel blasters or my participation in Paintball or Gel blaster activities. I specifically understand that I am releasing, discharging and waiving any claims or actions that I may have presently or in the future for the negligent acts or other conduct by the owners, agents, officers or employees of Choctaw Paintball and/or Madewell Enterprises, LLC. This waiver is good for one year from today's date.
MEDICAL PERMISSION
If the participant is of minority age, the undersigned parent or guardian hereby gives permission for Choctaw Paintball to authorize emergency medical treatment as may be deemed necessary for the child named below while participating in paintball games. I HAVE READ THE ABOVE WAIVER AND RELEASE AND BY SIGNING IT AGREE IT IS MY INTENTION TO EXEMPT AND RELIEVE CHOCTAW PAINTBALL AND/OR MADEWELL ENTERPRISES, LLC FROM LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH CAUSED BY NEGLIGENCE OR ANY OTHER CAUSE.
PHOTOGRAPHY/SOCIAL MEDIA RELEASE
I hereby grant permission to the Choctaw Paintball Club and/or Madewell Enterprises, LLC and its agents, licensees, and assigns, to use my image, likeness, and voice as recorded on audio and/or video and/or photographs without compensation for any lawful purpose, including but not limited to advertising, promotion, and social media use, in perpetuity throughout the world.
I understand that all photographs, videos, or other media taken during the course of events or activities are the sole property of the Choctaw Paintball Club and/or Madewell Enterprises, LLC and will be provided to me.
This release is effective as of the date signed below and shall remain in effect indefinitely, unless revoked in writing by me, which shall not affect any prior usage.
I waive any right to inspect or approve the finished product, including written copy, wherein my likeness appears. I release, discharge, and hold harmless the Choctaw Paintball Club and/or Madewell Enterprises, LLC, its employees, agents, licensees, and assigns from any claims, demands, or causes of action that I may have by reason of this authorization.
I understand that the Choctaw Paintball Club and/or Madewell Enterprises, LLC is not obligated to use my image or likeness, and may discontinue use at any time.
If the participant is under the age of 18, a parent or legal guardian must sign below, indicating consent to all terms.
This Release shall be governed by and construed in accordance with the laws of the State of Oklahoma. Any disputes This Release constitutes the entire understanding between the parties with respect to the subject matter hereof and supersedes all prior agreements or understandings, whether oral or written.
