IMPACT ARCHERY INC.
JOAD YOUTH PROGRAM MEMBERSHIP AGREEMENT, RELEASE OF LIABILITY, AND ASSUMPTION OF RISK
PLEASE READ CAREFULLY – THIS IS A LEGALLY BINDING AGREEMENT
In consideration for participation in the Impact Archery Inc. JOAD (Junior Olympic Archery Development) Program (the “Program”), I, the undersigned parent or legal guardian, agree as follows:
1. ASSUMPTION OF RISK
I understand that participation in archery activities involves inherent risks, including but not limited to:
- Injury from arrows, bows, or equipment
- Equipment failure or misuse
- Slips, trips, or falls within the range
- Actions of other participants
I acknowledge that these risks may result in serious injury, permanent disability, or death, and I voluntarily assume all such risks on behalf of the minor participant.
2. RELEASE OF LIABILITY
I, on behalf of myself and the minor participant, hereby release, waive, discharge, and covenant not to sue Impact Archery Inc., its owners, officers, employees, coaches, agents, and representatives (collectively, the “Released Parties”) from any and all claims arising out of or related to participation in the Program, including those caused by the negligence of the Released Parties, to the fullest extent permitted by Nevada law.
3. INDEMNIFICATION
I agree to indemnify, defend, and hold harmless the Released Parties from any claims, damages, or expenses (including attorney’s fees) arising from the minor’s participation, including claims brought by or on behalf of the minor.
4. MEDICAL AUTHORIZATION
I certify that the minor is physically able to participate. I authorize Impact Archery Inc. to obtain emergency medical treatment if necessary and agree to be financially responsible for any medical expenses incurred.
5. EQUIPMENT RESPONSIBILITY
I acknowledge that:
- The participant must use safe, properly maintained equipment
- The participant is responsible for ensuring their equipment is in working condition
- Impact Archery Inc. is not responsible for personal equipment damage or failure
6. PROGRAM RULES AND SAFETY
The participant agrees to follow all rules and coaching instructions, including:
- Following all range safety commands
- Using equipment properly and responsibly
- Refraining from unsafe or disruptive behavior
Failure to follow rules may result in removal from the Program without refund.
7. MEMBERSHIP TERMS
- Membership includes two weekly JOAD training sessions (currently Monday and Thursday, 6:00 PM – 8:00 PM)
- Membership also includes general range access, subject to availability
- The range may be closed for private events with advance notice
- Participants must provide their own equipment
8. BILLING AND CANCELLATION
- Monthly membership fee: $80.00
- Membership renews automatically using the card on file
- Cancellation must be submitted in writing at least 7 days prior to the renewal date
- Written cancellation may be submitted via email or text
- No partial refunds will be issued for unused time
9. FACILITY POLICIES
- The facility is under video surveillance for safety and security
- Any misuse, vandalism, or unsafe behavior may result in membership termination
- Participants must maintain current contact and billing information
10. MEDIA RELEASE
I grant Impact Archery Inc. the right to use the minor’s name, image, and likeness in photos or videos for promotional purposes. I understand no compensation will be provided.
11. GOVERNING LAW
This Agreement shall be governed by the laws of the State of Nevada.
12. DROP-OFF AND EMERGENCY CONTACT REQUIREMENTS
For participants who are dropped off without a parent or guardian remaining on-site, the parent or legal guardian agrees to the following:
- The parent/guardian must remain readily reachable by phone at all times during the participant’s attendance at the Program
- The parent/guardian must be able to return to the Facility within a reasonable period of time in the event of an emergency, injury, behavioral issue, or early dismissal
- The parent/guardian shall provide accurate and current emergency contact information and update it as needed
Impact Archery Inc. reserves the right to refuse unattended participation if a parent or guardian cannot be reliably reached or fails to respond in a timely manner when contacted.
In the event of an emergency where the parent/guardian cannot be reached, Impact Archery Inc. may take any action it deems reasonably necessary for the safety and well-being of the participant.
13. ACKNOWLEDGMENT
I have read and fully understand this Agreement. I understand that I am giving up legal rights on behalf of myself and the minor, including the right to sue. I agree voluntarily.
