IMPACT ARCHERY INC.
ARCHERY TAG ACTIVITY RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT
PLEASE READ CAREFULLY – THIS IS A LEGALLY BINDING DOCUMENT
In consideration for being permitted to participate in Archery Tag-style activities, games, events, or related activities (collectively, the “Activities”) at Impact Archery Inc. (the “Facility”), I agree as follows:
1. ASSUMPTION OF RISK
I understand that Archery Tag-style activities involve increased physical interaction and risk, including but not limited to:
- Being struck by foam-tipped arrows
- Slipping, tripping, or falling
- Collisions with other participants or objects
- Equipment malfunction or misuse
These risks may result in serious bodily injury, permanent disability, or death.
I knowingly and voluntarily assume all risks, both known and unknown, even if arising from the negligence of Impact Archery Inc. or others.
2. RELEASE OF LIABILITY
I hereby release, waive, discharge, and covenant not to sue Impact Archery Inc., its owners, officers, employees, instructors, agents, representatives, successors, and assigns (collectively, the “Released Parties”) from any and all liability arising out of or related to injury, illness, death, or property damage resulting from my participation in the Activities, including those caused by the negligence of the Released Parties, to the fullest extent permitted by law.
3. INDEMNIFICATION
I agree to indemnify, defend, and hold harmless the Released Parties from any claims, damages, losses, liabilities, or expenses (including attorney’s fees) arising from my participation or from any claim brought by a third party as a result of my actions.
4. RULES, EQUIPMENT, AND SAFETY
I agree to follow all rules and staff instructions, including:
- Wearing all required protective gear (including face/eye protection)
- Using only approved equipment
- No physical contact outside of normal gameplay
- No reckless, aggressive, or unsafe behavior
I understand that failure to follow rules may result in removal without refund.
I accept full responsibility for any additional risk caused by my failure to follow safety instructions.
5. MEDICAL AUTHORIZATION
I certify that I am physically fit to participate. I authorize Impact Archery Inc. to obtain emergency medical care if necessary and agree to be responsible for all related costs.
6. PARENT / GUARDIAN CONSENT (FOR MINORS)
If signing on behalf of a minor, I certify that I am the parent or legal guardian and agree to all terms of this Agreement on behalf of the minor.
I further agree to indemnify and hold harmless the Released Parties from any claims brought by or on behalf of the minor, including those arising from negligence.
7. MEDIA / TALENT RELEASE
I grant Impact Archery Inc. the irrevocable, perpetual, worldwide right to use my (or the minor’s) name, image, likeness, voice, and appearance in photographs or video recordings for marketing, promotional, or commercial purposes.
I understand:
- I will receive no compensation
- Impact Archery Inc. owns all rights to such media
- Media may be edited and used in any format
I release any claims related to the use of such media.
8. GOVERNING LAW
This Agreement shall be governed by the laws of the State of Nevada.
9. SEVERABILITY
If any portion of this Agreement is held invalid, the remaining provisions shall continue in full force.
10. ACKNOWLEDGMENT
I have read this Agreement, understand its terms, and understand that I am giving up legal rights, including the right to sue. I sign voluntarily.
