IMPACT ARCHERY INC.
24-HOUR RANGE ACCESS AGREEMENT, RELEASE OF LIABILITY, AND ASSUMPTION OF RISK
PLEASE READ CAREFULLY – THIS IS A LEGALLY BINDING AGREEMENT
In consideration for being granted 24-hour access to the Impact Archery Inc. facility and shooting range (the “Facility”), I agree as follows:
1. ASSUMPTION OF RISK
I understand that use of the Facility after normal business hours involves heightened risks, including but not limited to:
- Lack of staff supervision or assistance
- Delayed emergency response
- Equipment malfunction or misuse
- Slips, trips, falls, or unsafe conditions
- Actions of other participants
I acknowledge that these risks may result in serious bodily injury, permanent disability, or death, and I knowingly and voluntarily assume all such risks, including those arising from the negligence of Impact Archery Inc., to the fullest extent permitted by Nevada law.
2. RELEASE OF LIABILITY
I hereby release, waive, discharge, and covenant not to sue Impact Archery Inc., its owners, officers, employees, agents, and representatives (collectively, the “Released Parties”) from any and all liability arising out of or related to my use of the Facility, including during unstaffed hours and including claims caused by the negligence of the Released Parties, to the fullest extent permitted by law.
3. INDEMNIFICATION
I agree to indemnify, defend, and hold harmless the Released Parties from any claims, damages, losses, or expenses (including attorney’s fees) arising from my use of the Facility or my actions, to the fullest extent permitted by Nevada law.
4. ACCESS CONTROL AND SECURITY
- Access is limited to approved 24-hour members with an active PIN code
- Each individual must enter using their own unique PIN
- Sharing PINs or allowing entry to non-members is strictly prohibited
- Members are responsible for maintaining the confidentiality of their PIN
Violation of these rules may result in immediate termination of access.
5. AFTER-HOURS USE CONDITIONS
I acknowledge and agree:
- No staff will be present during after-hours use
- I am entering and using the Facility entirely at my own risk
- I am responsible for turning on/off lights, climate controls, and securing the Facility upon exit
- I must immediately stop shooting if the entry alarm sounds and ensure safe conditions for incoming participants
6. SAFETY RULES AND CONDUCT
I agree to:
- Follow all posted rules and previously provided safety instruction
- Use equipment properly and responsibly
- Ensure my equipment is in safe working condition
- Refrain from reckless, unsafe, or disruptive behavior
Failure to follow rules may result in immediate termination without refund.
7. EQUIPMENT RESTRICTIONS
- Only approved archery equipment may be used
- No bow presses or equipment repair/modification activities are permitted after hours
- All equipment must be maintained in safe working condition
8. INCIDENT REPORTING
In the event of any accident, injury, or unusual occurrence, I agree to immediately notify Impact Archery Inc. via email or text at 702-701-7766.
9. SURVEILLANCE AND ENFORCEMENT
- The Facility is under 24-hour video surveillance
- Any misuse, vandalism, or violation of rules may result in termination and possible legal action
10. BILLING AND MEMBERSHIP TERMS
- Monthly fee for 24-hour access: $85.00
- Membership renews automatically using the card on file
- If payment fails, access may be suspended after five (5) business days
- Members must maintain current contact and billing information
11. NO GUEST POLICY
I understand that I may not admit any other individual into the Facility. Each participant must have their own active membership and access credentials.
12. MEDICAL AND EMERGENCY ACKNOWLEDGMENT
I understand that emergency response may be delayed during after-hours use and accept full responsibility for any resulting risks.
13. RULE CHANGES
I acknowledge that rules and policies may be updated from time to time, and I will be notified of any material changes.
14. GOVERNING LAW
This Agreement shall be governed by the laws of the State of Nevada.
15. SEVERABILITY
If any provision of this Agreement is held invalid, the remaining provisions shall remain in full force and effect.
16. ACKNOWLEDGMENT
I have read and fully understand this Agreement. I understand that I am giving up legal rights, including the right to sue. I sign this Agreement voluntarily.
I acknowledge that this Agreement is intended to be as broad and inclusive as permitted by the laws of the State of Nevada.
