IMPACT ARCHERY INC.
RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT
PLEASE READ CAREFULLY – THIS IS A LEGALLY BINDING DOCUMENT
In consideration for being permitted to enter, observe, or participate in any activities at Impact Archery Inc. (the “Facility”), including but not limited to archery shooting, lessons, equipment use, events, or related activities (collectively, the “Activities”), I, the undersigned, agree as follows:
1. ASSUMPTION OF RISK
I understand that participation in archery and related activities involves inherent risks, including but not limited to serious bodily injury, permanent disability, paralysis, or death, as well as property damage. These risks may arise from my own actions, the actions of others, equipment failure, or the condition of the premises.
I knowingly and voluntarily assume all risks, both known and unknown, even if arising from the negligence of Impact Archery Inc. or others.
2. RELEASE OF LIABILITY
I hereby release, waive, discharge, and covenant not to sue Impact Archery Inc., its owners, officers, employees, instructors, agents, representatives, successors, and assigns (collectively, the “Released Parties”) from any and all liability, claims, demands, damages, losses, or causes of action arising out of or related to any injury, illness, death, or property damage resulting from my participation in the Activities, including those caused by the negligence of the Released Parties, to the fullest extent permitted by law.
3. INDEMNIFICATION
I agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, damages, losses, liabilities, costs, or expenses (including attorney’s fees) arising out of or related to my participation in the Activities, including any claims brought by third parties.
4. RULES AND SAFETY REQUIREMENTS
I agree to follow all posted rules and staff instructions, including but not limited to:
- Wearing proper footwear (closed-toe, secure shoes) at all times while participating
- Using equipment safely and as instructed
- Refraining from unsafe or reckless behavior
I understand that failure to follow safety rules may result in removal from the Facility without refund.
If I choose not to follow safety requirements, I assume all additional risks and liability associated with that decision.
5. MEDICAL AUTHORIZATION
I certify that I am physically able to participate in the Activities. In the event of an emergency, I authorize Impact Archery Inc. to obtain medical treatment on my behalf. I agree to be responsible for any and all medical costs incurred.
6. PARENT / GUARDIAN CONSENT (FOR MINORS)
If signing on behalf of a minor, I certify that I am the parent or legal guardian and have the authority to sign this agreement.
I agree, on behalf of the minor, to all terms of this Agreement, including the release of liability and assumption of risk.
I further agree to indemnify and hold harmless the Released Parties from any claims brought by or on behalf of the minor, including those arising from negligence.
7. MEDIA / TALENT RELEASE
I grant Impact Archery Inc. the irrevocable, perpetual, worldwide right to use my (or the minor’s) name, image, likeness, voice, and appearance in photographs, videos, or other media (“Media”) for promotional, advertising, social media, or any lawful purpose.
I understand that:
- Impact Archery Inc. will have full ownership of such Media
- I will receive no compensation
- Media may be edited, reproduced, and distributed in any format
I release and waive any claims related to the use of such Media, including claims for compensation or invasion of privacy.
8. GOVERNING LAW
This Agreement shall be governed by and interpreted in accordance with the laws of the State of Nevada.
9. SEVERABILITY
If any portion of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.
10. ACKNOWLEDGMENT
I have read this Agreement, fully understand its terms, and understand that I am giving up substantial legal rights, including the right to sue. I sign this Agreement freely and voluntarily.
