IMPACT ARCHERY INC.
MONTHLY MEMBERSHIP AGREEMENT, RELEASE OF LIABILITY, AND ASSUMPTION OF RISK
PLEASE READ CAREFULLY – THIS IS A LEGALLY BINDING AGREEMENT
In consideration for being granted access to the Impact Archery Inc. facility and shooting range (the “Facility”), I agree as follows:
1. ASSUMPTION OF RISK
I understand that participation in archery and use of the Facility involves inherent risks, including but not limited to:
- Injury from arrows, bows, or equipment
- Equipment failure or misuse
- Slips, trips, or falls
- Actions of other participants
I acknowledge that these risks may result in serious bodily injury, permanent disability, or death, and I knowingly and voluntarily assume all such risks, including those arising from the negligence of Impact Archery Inc., to the fullest extent permitted by Nevada law.
2. RELEASE OF LIABILITY
I hereby release, waive, discharge, and covenant not to sue Impact Archery Inc., its owners, officers, employees, agents, and representatives (collectively, the “Released Parties”) from any and all claims arising out of or related to my use of the Facility, including claims caused by the negligence of the Released Parties, to the fullest extent permitted by law.
3. INDEMNIFICATION
I agree to indemnify, defend, and hold harmless the Released Parties from any claims, damages, losses, or expenses (including attorney’s fees) arising from my use of the Facility or my actions, to the fullest extent permitted by Nevada law.
4. MEMBERSHIP TERMS
- Monthly membership includes access to the shooting range during normal business hours: Monday–Sunday, 10:00 AM – 8:00 PM
- Membership covers range fees and targets only
- Range access may be unavailable during private events, with advance notice provided via email and/or social media
- Members must provide and use their own equipment
- Members may remain in the range during open hours as long as they comply with all rules
5. OPTIONAL 24-HOUR ACCESS
If granted 24-hour access, I acknowledge and agree:
- I may access the Facility outside staffed hours at my own risk
- No staff supervision will be present
- I assume additional risks associated with unsupervised use
- I am responsible for securing the facility upon entry/exit
6. SAFETY RULES AND CONDUCT
I agree to:
- Follow all posted rules and staff instructions
- Use equipment safely and responsibly
- Ensure my equipment is in proper working condition
- Refrain from reckless, unsafe, or disruptive behavior
Failure to follow rules may result in immediate termination of membership without refund.
7. EQUIPMENT RESPONSIBILITY
I acknowledge that:
- I am solely responsible for the condition and safety of my equipment
- Impact Archery Inc. is not responsible for equipment damage, loss, or failure
8. INCIDENT REPORTING
I agree that if any accident, injury, or incident occurs—especially during unstaffed hours—I will immediately notify Impact Archery Inc. via phone or text at 702-701-7766.
9. FACILITY POLICIES
- The Facility is under 24-hour video surveillance
- Vandalism, misuse, or unsafe behavior may result in termination and possible legal action
- Members must maintain current contact and billing information
10. BILLING AND CANCELLATION
- Monthly membership fee: $60.00
- Membership renews automatically using the card on file
- Cancellation must be submitted in writing at least 3 days prior to the renewal date
- Cancellation may be submitted via email or text
- No partial refunds will be issued
11. MEDICAL AUTHORIZATION
In the event of an emergency, I authorize Impact Archery Inc. to obtain medical care on my behalf and agree to be responsible for all associated costs.
12. GOVERNING LAW
This Agreement shall be governed by the laws of the State of Nevada.
13. SEVERABILITY
If any portion of this Agreement is held invalid, the remaining provisions shall remain in full force and effect.
14. ACKNOWLEDGMENT
I have read and fully understand this Agreement. I understand that I am giving up legal rights, including the right to sue. I sign this Agreement voluntarily.
I acknowledge that this Agreement is intended to be as broad and inclusive as permitted by the laws of the State of Nevada.
