AGREEMENT FOR PARTICIPANTS' RELEASE AND DISCHARGE, ACCEPTANCE OF RESPONSIBILITY AND ACKNOWLEDGEMENT OF RISKS

I, the undersigned, being 18 years of age or older, or the legal guardian of the the undersigned person who is under 18, in consideration of my desire to participate in various activities at Kamp Taylor, the residence of KIMOTHY TAYLOR and BEVERLY TAYLOR (the "Taylors") and owned by the Kimothy H Taylor Living Trust (the "Trust"), located at 2512 TALL TREES LOOP FOREST LAKES, ARIZONA 85931 (hereinafter referred to as "Kamp Taylor"), and the right to engage in this event.

I hereby, for myself, my heirs, executors, administrators, assigns, or personal representatives (hereinafter collectively "I"), knowingly and voluntarily enter this WAIVER AND RELEASE OF LIABILITY (this "Waiver") and hereby acknowledge and agree as follows.

ACKNOWLEDGEMENT OF RISKS

I understand and acknowledge that the activity I am about to voluntarily engage in bears certain known or unknown risks which could result in injury, death, illness or disease, physical or mental damage to myself, or damage to my property. Among these risks related to Kamp Taylor, but not all inclusive, are the following:

1. The nature of the activity itself.
2. The negligent acts or omissions of the Taylors and their agents, contractors, or employees.
3. Latent or apparent defects or conditions in any venues, equipment, animals, or activities supplied by the Taylors or their agents, contractors, or employees.
4. Use or operation by myself or others of any personal effects, equipment, supplies, plants, or animals supplied by the Taylors or their agents, contractors, or employees.
5. Weather conditions, including wet grounds, ice, or snow.
6. Contact with other guests, invitees, plants, animals, or food or drink consumption.
7. My physical or mental condition, including being under the influence of drugs or alcohol, or my acts or omissions.
8. The condition of grounds, vehicles, sporting facilities, hiking trails, playground equipment, pools, equipment, walkways, and related areas and accidents connected with their use.
9. First-aid, emergency treatment, or other services rendered; or
10. Behavior, death, or disease of animals.

 ACCEPTANCE OF RISK AND RESPONSIBILITY

Being aware that this activity may be inherently dangerous and entails certain risks of injury to myself identified in the paragraph above, I agree, covenant and promise to accept and assume the risk of injury, death, illness, or disease, or damage to myself or my property arising from my participation in this activity. My participation in this activity is purely voluntary; no one forces me to participate, and I elect to participate despite the risks. I agree that it is my sole responsibility to determine whether I am sufficiently fit and healthy enough to visit Kamp Taylor and to participate in any activities, that I am responsible for my  safety and well being at all times and under all circumstances while at Kamp Taylor or utilizing Kamp Taylor equipment, vehicles, or machinery on or off the property.  I accept sole responsibility for my conduct and actions while visiting or participating in any events at Kamp Taylor.

RELEASE

I hereby voluntarily agree to release and hold harmless the Trust, the Taylors, Kamp Taylor, their family members, their agents, owners, contractors, and employees from their negligent acts or omissions which may cause injury, death, illness or disease, or damage to myself or my property while participating in this activity. I hereby voluntarily agree to release, hold harmless, and indemnify the Trust, the Taylors, Kamp Taylor, their family members, their agents, owners, contractors, or employees from any claims, demands, actions, or rights of action arising from my willful, intentional, or negligent acts or omissions while participating in this activity. I further agree, promise, and covenant not to sue, assert, or otherwise maintain or assert any claim against the Taylors, Kamp Taylor, their family members, their agents, owners, contractors, or employees, for any legal claims specifically waived or released in this Agreement.

IN SIGNING THIS DOCUMENT, I FULLY RECOGNIZE THAT IF I AM HURT OR PROPERTY IS DAMAGED WHILE I AM VISITING KAMP TAYLOR OR ENGAGED AT AN EVENT AT KAMP TAYLOR OR UTILIZING VEHICLES OR EQUIPMENT ON OR OFF PROPERTY, I WILL HAVE NO RIGHT TO MAKE A CLAIM OR FILE A LAWSUIT AGAINST THE TRUST, THE TAYLORS, KAMP TAYLOR, OR ANY OF THEIR AGENTS, CONTRACTORS, OR EMPLOYEES, EVEN IF THEY OR ANY OF THEM NEGLIGENTLY CAUSED THE BODILY INJURY OR PROPERTY DAMAGE.

 ELECTRONIC SIGNATURES

This Waiver may be executed and delivered by any party by fax or electronic mail, and a party's facsimile or electronic signature on this Waiver shall have the same force and effect as an original signature.

 ACKNOWLEDGEMENT OF EFFECT OF RELEASE AGREEMENT

I understand and acknowledge that by initializing and/or signing this document I have given up claim to certain rights and/or possible claims which I might otherwise assert or maintain against the Trust, the Taylors, Kamp Taylor, their owners, agents, contractors, officers, or employees, including specifically, rights arising from or claims for the negligent acts or omissions of the Trust, the Taylors, Kamp Taylor, or their agents, contractors, or employees. I also understand and acknowledge that I have assumed responsibility and legal liability for the claims or other legal demands, including defense costs, which may be asserted by third parties against the Trust, the Taylors and Kamp Taylor that are directly attributable to my willful or deliberate acts, or negligent acts or omissions arising from participation in this event. I understand that this is the entire Agreement between me and the Trust, the Taylors, and Kamp Taylor, and it cannot be modified or changed in any way by the representations or statements of any employee or agent of the Trust, the Taylors, or Kamp Taylor or by me.
