PARTICIPATION WAIVER, RELEASE OF LIABILITY
Effective Period: September 1 through August 31 annually, beginning on the date of signing.
In consideration of being permitted to enter, observe, participate in, or otherwise be present at any
athletic or sports program, activity, league, camp, clinic, tournament, rental, or event (collectively,
“Activities”) at any National Sport Group, LLC and National Sports Group II, LLC Activities
including any Activities of any subsidiary companies or properties of National Sport Group, LLC
and National Sports Group II, LLC (collectively referred to as NSG), whether as a Participant Or
Spectator (collectively sometimes referred to as “Participant(s)”), the Undersigned Agrees To This
Participation Waiver, Release Of Liability And The Assumption Of Risk, Data Use & Marketing
Consent Hereunder As Follows:
1. Required Information Collection From Adult Participants And Parent Or Legal Guardian Of
Minor Participants: Each adult Participant or spectator, parent or legal guardian of any minor
Participant or athlete of Activities of NSG must provide the following information as part of this
waiver:
• Full legal name
• Residential address
• Phone number
• Email address
This information is required for identity verification, safety, administrative communications, and
record-keeping and NSG will also use this information for marketing communications as per
paragraphs 11-13 below.
2. Inspection & Assumption Of Premises Conditions: Prior to participation or remaining on the
premises, I agree to inspect the facilities, equipment, playing surfaces, and surrounding areas. If I
believe any condition is unsafe, I will immediately notify NSG personnel at the front desk and will
not participate or remain until the condition is addressed. I specifically acknowledge and accept
that: (1) field netting may contain wire ties, chains, or attachments; (2) goals or equipment may be
stored adjacent to playing areas; and (3) indoor and outdoor field surfaces may be uneven or
imperfect.
3. Acknowledgment Of Inherent Risks: I understand that athletic and sports activities involve
inherent risks, including serious bodily injury, permanent disability, paralysis, or death. These
risks may arise from my own actions, the actions or negligence of others, rules of play,
environmental conditions, or equipment used.
4. Assumption Of Responsibility & Risk: I voluntarily assume full responsibility for all risks of
injury, illness, damage, or loss arising from my presence at or participation in NSG Activities,
including risks associated with storing equipment, seating and uneven surfaces, except to the extent
caused by NSG’s gross negligence or willful misconduct, which is not waived.
5. Health Representation & Emergency Medical Authorization: I represent that I (and any minor
for whom I am signing) am physically and medically able to participate. In the event of an
emergency, I authorize NSG staff or medical personnel to obtain medical treatment and accept
responsibility for all associated costs. I release NSG from liability for emergency care or rescue
efforts, including alleged ordinary negligence.
6. Release & Waiver Of Liability: To the fullest extent permitted by law, I release, waive,
discharge, and agree not to sue NSG and its owners, members, managers, employees, volunteers,
agents, coaches, referees, officials, sponsors, advertisers, landlords, lessees, and other participants
(“Releasees”) from any and all claims for personal injury, death, or property damage arising out
of or related to my or my child’s participation in or presence at NSG Activities, whether occurring
inside or outside the facilities, including parking areas and exterior grounds. This release applies
only to ordinary negligence and does not apply to gross negligence or willful misconduct where
such claims may not legally be waived.
7. Minors: I certify that I am the parent or legal guardian of the minor listed below and have
authority to execute this waiver on the minor’s behalf. I agree to defend and indemnify NSG
against claims brought by or on behalf of the minor to the fullest extent permitted by law.
8. Photography & Video Consent: I grant NSG permission to photograph or record me or my
child during Activities and to use such images for promotional, marketing, or informational
purposes without compensation.
9. Program Terms & Policies: I acknowledge that (1) all program and registration fees are
non-refundable; (2) Pro-rated payments are not permitted; (3) weather-related cancellations will
not be rescheduled or refunded; and (4) program schedules will be posted on the Oakwood
Sports Center Website and the Oakwood Soccer Club Website.

10. Communications: By registering, I expressly consent to receive administrative and
transactional emails related to my registration and participation at NSG.
11. Marketing Communications – Express Consent Provisions: (1) I expressly consent to receive
NSG post-event marketing communications from NSG and via email and/or text message. (2) I
completely understand that my consent is affirmative by signing this Participation Waiver and
Release of Liability not implied; (3) consent is not a condition of purchase, registration, or
attendance; (4) I may opt out at any time by following unsubscribe instructions and NSG will
promptly cease providing any marketing communications post my opt out; and (5) message and
data rates may apply.
12. Use & Sharing Of Collected Data: NSG may use collected information provided by the parent
or legal guardian of the Participant only for lawful marketing and event-related communications,
personal information will not be sold or transferred to unaffiliated third parties and NSG shall
comply with all required laws and regulations.
13. Notice: Any notice, request, opt-out, or other communication permitted or required under this
Agreement shall be in writing and may be delivered by (1) personal delivery, (2) email, or (3) firstclass mail. Notices shall be deemed received upon delivery if personally delivered, upon
transmission if sent by email, or three (3) days after mailing if sent by first-class mail. Notices to
NSG shall be sent to NSG, 16 W. Hanover Ave., Randolph, NJ 07869.
14. Dispute Resolution; Governing Law: Any dispute arising out of or relating to NSG Activities
or this Agreement shall be resolved exclusively by binding arbitration in New Jersey conducted in
accordance with the New Jersey Arbitration Act and governed by the laws of that state without
regard to conflict of interest laws principals. Notwithstanding the foregoing, nothing in this
Agreement shall waive or limit any non-waivable rights or protections afforded under applicable
Connecticut law. Judgment on the arbitration award may be entered in any court of competent
jurisdiction.
15. SEVERABILITY & ENTIRE AGREEMENT
If any provision is found unenforceable, the remainder shall continue in full force and effect. This
document constitutes the entire agreement and may not be modified orally.
