Direct Credit Card Billing Agreement
1. 1. The credit cardholder hereby guarantees payment of all charges incurred by the enrolled members associated with the credit card, including, without limitation, the individuals listed below, in respect of whom the credit cardholder has elected to associate their membership and purchases made at Tremblant’s rental and retail locations with the credit card.
2. 2. The holder of a Tremblant Pass (the “Applicant”) who elects the Direct Billing option acknowledges and agrees that they may proceed directly to Tremblant’s rental and retail locations, present their Tremblant Pass, and have the applicable charges billed directly to the credit card identified below. By presenting and using their Tremblant Pass, the Applicant expressly authorizes Tremblant to charge such credit card for all fees, charges, purchases, rentals and other amounts incurred by the Applicant at Tremblant.
3. 3. The Applicant acknowledges and agrees that, by electing the Direct Billing option, they are authorized to charge purchases and other applicable fees to the credit card identified below, in accordance with the terms and conditions of this Agreement.
4. 4. The Applicant expressly acknowledges and agrees to assume full responsibility for the payment of all charges incurred through the use of the Direct Billing option at locations where the Applicant’s signature is not required to authorize the transaction.
5. 5. In the event that any transaction submitted to the credit card is declined, refused or otherwise cannot be processed, Tremblant reserves the right to temporarily suspend the Applicant’s Tremblant Pass and/or Direct Billing privileges until all outstanding amounts have been paid in full and collected by Tremblant. Tremblant further reserves the right, at its sole and absolute discretion, to revoke the Applicant’s Direct Billing option and any privileges associated therewith, without prior notice.
6. 6. The Applicant acknowledges and agrees that they are solely responsible for promptly notifying Tremblant of any change affecting the credit card associated with the Direct Billing option, including, without limitation, any change to the credit card number, expiry date or other relevant card information, as well as any change to the individuals associated with the credit card, including the addition or removal of any name. Any modification to the credit card information or to the individuals authorized or associated under this Agreement may require the Applicant to complete and execute a new Direct Credit Card Billing Agreement.
7. 7. The Applicant or the credit cardholder may terminate this Agreement by providing notice to Tremblant in person at Customer Service, by mail or by email. Notwithstanding such termination, the credit cardholder shall remain fully liable for and shall be responsible for payment of all charges, purchases, rentals, fees and other amounts incurred prior to the effective date of termination by any Tremblant Pass holder associated with the credit card.
8. 8. This Agreement shall remain applicable to any subsequent renewal of a Tremblant season pass or Tremblant Card and/or to any subsequent purchase made by the Applicant or an associated Pass holder, whether such purchase is made online, by telephone, by mail or in person, unless and until this Agreement is terminated in accordance with its terms or otherwise superseded by a subsequent agreement.
Tremblant reserves the right, at any time and without prior notice, to amend the terms and conditions applicable to the season pass or Tremblant Card.
