General Family & Participant Waiver
This General Family & Participant Waiver ("Waiver") is entered into by the undersigned adult participant and/or parent or legal guardian ("Participant/Guardian") for participation in activities at The Hitch Family Fun Center & Party Rentals LLC ("The Hitch Family Fun Center & Party Rentals LLC"). By signing this Waiver, the Participant/Guardian acknowledges and agrees to the terms below for themselves and, where legally permitted, for the minor children identified below.

1. Activities Covered
a. This Waiver applies to participation in and use of recreational activities, arcade games, gaming lounge equipment, play areas, board games, concessions areas, common areas, and other attractions made available by The Hitch Family Fun Center & Party Rentals LLC, including activities offered during general admission, parties, and private events.
b. The Participant/Guardian understands that activities and equipment available at The Hitch Family Fun Center & Party Rentals LLC may change from time to time.
2. Assumption of Risk
a. The Participant/Guardian understands that recreational activities may involve inherent and other risks, including slips, trips, falls, collisions with people or objects, equipment-related injuries, and other risks that may result in bodily injury or property damage.
b. The Participant/Guardian voluntarily assumes the risks associated with participation and use of The Hitch Family Fun Center & Party Rentals LLC's activities and equipment to the fullest extent permitted by applicable law.
3. Parent or Guardian Responsibility for Minors
a. The Participant/Guardian represents that they are the parent or legal guardian of, or otherwise have legal authority to execute this Waiver for, each minor child identified above.
b. The Participant/Guardian accepts responsibility for appropriate supervision of minor children in their care and agrees to ensure that those children follow posted rules and reasonable instructions from The Hitch Family Fun Center & Party Rentals LLC staff.
c. The Participant/Guardian understands that The Hitch Family Fun Center & Party Rentals LLC does not assume responsibility for supervising minor children unless a separate written program or service specifically states otherwise.
4. Rules and Safe Conduct
a. The Participant/Guardian agrees that they and the minor children in their care will use equipment and participate in activities only as intended and will comply with posted rules and reasonable safety instructions.
b. Unsafe, destructive, abusive, unlawful, or disruptive conduct may result in removal from an activity or the facility.
c. Gambling is strictly prohibited on the premises. No activity, game, tournament, or competition may involve wagering or betting money, property, prizes, or anything else of value between participants. Games and recreational activities provided by The Hitch Family Fun Center & Party Rentals LLC are for entertainment purposes only.
d. Illegal drugs and other unlawful controlled substances are prohibited on the premises.
e. Smoking and vaping are prohibited inside the facility and in any other areas designated as non-smoking or non-vaping by The Hitch Family Fun Center & Party Rentals LLC.
f. Weapons are prohibited on the premises to the extent permitted by applicable law and Company policy.
g. Fighting, threats, harassment, dangerous conduct, and other unlawful or seriously disruptive behavior are prohibited and may result in immediate removal from the premises.
5. Gaming Lounge
a. The Gaming Lounge may include racing, sports, platform, adventure, puzzle, strategy, sandbox/ building, simulation, action, shooter, fighting, fantasy combat, horror/survival, and online multiplayer games. Games may carry ESRB ratings including E, E10+, T, or M. Parents/Guardians are responsible for determining appropriate game access. Management may restrict access based on age, behavior, parental request, or operational needs.
6. Release and Waiver of Liability
a. To the fullest extent permitted by applicable law, the Participant/Guardian releases and agrees not to hold The Hitch Family Fun Center & Party Rentals LLC, its owners, employees, and agents liable for claims for injury, loss, or property damage arising from the ordinary risks of participation or from the Participant's misuse of equipment, failure to follow rules or instructions, or negligent or intentional acts of the Participant.
b. Nothing in this Waiver is intended to release or waive liability that cannot legally be released or waived under applicable law.
7. Medical Emergencies
a. In the event of an emergency involving a minor in the Participant/Guardian's care, the Participant/Guardian authorizes The Hitch Family Fun Center & Party Rentals LLC staff to contact emergency services when reasonably believed necessary.
b. The Participant/Guardian understands that The Hitch Family Fun Center & Party Rentals LLC does not provide medical care and that the
Participant/Guardian remains responsible for medical costs incurred for themselves or minors in their care, except as otherwise required by law.
8. Personal Property
a. The Participant/Guardian understands that The Hitch Family Fun Center & Party Rentals LLC is not responsible for lost, stolen, or unattended personal property to the fullest extent permitted by law.
9. Security Camera Notice
a. The facility uses video surveillance for the safety of guests, employees, and property. Recordings may be used for incident investigations, insurance claims, security, and other lawful business purposes.
10. Photo and Video Permission Please select one:
YES I authorize The Hitch Family Fun Center & Party Rentals LLC to photograph, video record, or otherwise capture images or recordings of me and/or the minor child(ren) identified in this Waiver while participating in activities at the facility. I understand these images or recordings may be used for lawful business purposes, including advertising, marketing, promotional materials, social media, the Company’s website, printed materials, and other promotional publications. I understand that I will receive no payment, royalty, compensation, or other consideration for the use of such photographs, videos, or recordings. I further understand that The Hitch Family Fun Center & Party Rentals LLC may edit, crop, reproduce, publish, distribute, or otherwise use such materials without further notice or approval, to the extent permitted by law.
NO I do not authorize The Hitch Family Fun Center & Party Rentals LLC to use photographs or videos of me and/or the minor child(ren) identified in this Waiver for marketing or promotional purposes.
Choosing NO will not affect admission, participation, or eligibility to use the facility or its services. The Hitch Family Fun Center & Party Rentals LLC will make reasonable efforts to honor this selection, although incidental appearance in the background of photographs or videos taken in public areas of the facility may not always be avoidable.
11. Duration of Waiver
a. This Waiver is intended to remain in effect for the Participant/Guardian and the minor children identified above for current and future visits to The Hitch Family Fun Center & Party Rentals LLC until revoked in writing or replaced by an updated Waiver, to the extent permitted by applicable law.
b. The Hitch Family Fun Center & Party Rentals LLC may require a new Waiver at any time, including when this Waiver, facility activities, policies, or applicable legal requirements materially change.
12. Acknowledgment and Signature
By signing below, I acknowledge that I have read and understand this Waiver, understand that it affects legal rights, and voluntarily agree to its terms. I certify that the information I provided is accurate and that I have authority to sign for the minor child(ren) identified above where required.
13. Severability
If any provision of this Waiver is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect to the extent permitted by law.
