Intramural Waiver and release Acknowledgment
The undersigned PARTICIPANT acknowledges that the PARTICIPANT is voluntarily participating in intramural sports, club sports, recreational
activities, fitness activities, tournaments, practices, competitions, instructional clinics, use of recreational facilities and equipment, and any other
recreational or wellness activities sponsored, administered, organized, or authorized by the University of Arkansas at Fort Smith, including but not
limited to flag football, softball, outdoor soccer, 5v5 basketball, ping pong, bucket golf, 3v3 basketball, volleyball, indoor soccer, ultimate frisbee,
dodgeball, kickball, pickleball, picklefoot, and any associated practices, competitions, use of facilities, equipment, and related activities
(collectively, the "ACTIVITIES").
In consideration of UAFS making the ACTIVITIES available and providing facilities and equipment for the ACTIVITIES, PARTICIPANT, spouse (if any),
legal representatives, heirs, next of kin and assigns hereby forever releases, waives, and covenants not to sue The Board of Trustees of the University of
Arkansas acting for and on behalf of the University of Arkansas at Fort Smith, its officers, agents, and employees from any and all liability to
PARTICIPANT, spouse (if any), legal representatives, heirs and assigns for any and all loss, claims, damages, lawsuits, demands, or causes of action
whatsoever that PARTICIPANT may hereafter accrue, as the direct or indirect result of PARTICIPANT'S participation in ACTIVITIES.
PARTICIPANT acknowledges that these ACTIVITIES are each potentially hazardous. PARTICIPANT understands that while participating in these
ACTIVITIES, PARTICIPANT will be exposed to above-normal risks of injury and that although UAFS has taken precautions to provide safety equipment for
each activity, it is impossible for UAFS to guarantee absolute safety. PARTICIPANT understands that the PARTICIPANT bears the responsibility for safety
while participating in any intramural or club sport activity and voluntarily assumes full responsibility for the risk of bodily injury, death, medical expenses, loss of
income, or property damage while participating in the ACTIVITIES, whether it is due to the active or passive negligence or otherwise of UAFS. PARTICIPANT
acknowledges the PARTICIPANT'S personal responsibility to follow established rules of safety, obey all laws, fully utilize the safety equipment, provided
for these ACTIVITIES, and to follow the instructions and commands of UAFS employees or officials during participation in any of these ACTIVITIES.
PARTICIPANT acknowledges that the PARTICIPANT has been fully advised of the potential hazards including cuts, sprains, bruises, fractures, internal
injuries, disfigurement (permanent or otherwise), blindness, paralysis, suffocation, broken bones, and other serious or even life-threatening injuries.
With full knowledge of the risks involved, PARTICIPANT voluntarily releases and forever discharges The Board of Trustees of the University of Arkansas,
acting for and on behalf of the University of Arkansas at Fort Smith, together with its officers, agents, and employees, from any and all liability, claims, demands,
damages, lawsuits, losses, or causes of action that PARTICIPANT, spouse (if any), legal representatives, heirs, or assigns, may now have or hereafter acquire,
arising directly or indirectly from PARTICIPANT'S participation in recreational and/or club sport ACTIVITIES. PARTICIPANT acknowledges and agrees
that the PARTICIPANT is solely responsible for all costs arising from any bodily injury or property damage sustained as a result of such participation. This
release is intended to be as broad and inclusive as permitted under the laws of the State of Arkansas, shall be governed by the laws of the State of Arkansas,
and if any provision is determined to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. Nothing in this Release shall be
construed as a waiver of the sovereign immunity of the State of Arkansas.
PARTICIPANT grants The Board of Trustees of the University of Arkansas acting for and on behalf of the University of Arkansas at Fort Smith permission to
use, without compensation, the PARTICIPANT'S name, image, photograph, video, voice, and likeness for educational, promotional, marketing, public relations,
recruitment, fundraising, and other lawful University purposes in print, broadcast, digital, online, social media, and other media.

THIS DOCUMENT RELEASES The Board of Trustees of the University of Arkansas acting for and on behalf of the University of Arkansas at Fort
Smith FROM ANY LIABILITY RESULTING FROM MY PARTICIPATION IN ANY INTRAMURAL/RECREATIONAL SPORT ACTIVITIES.
By signing below, I acknowledge that I have had the opportunity to read this Release carefully, ask questions concerning its contents, and that I voluntarily sign it
with full knowledge of its legal effect. I also acknowledge that if I am not at least 18 years of age at the time of signing this document that a guardian signature is
also required. If signing on behalf of the above-named PARTICIPANT who is under eighteen (18) years of age, I hereby represent and agree that I am the
Parent/Guardian of the above-named PARTICIPANT who is under eighteen (18) years of age and am fully competent to sign this liability waiver and release
agreement.
