THIRTEENTH HOUR HAUNTED ATTRACTION ADMITTANCE WAIVER
MINORS UNDER 18 MUST HAVE A PARENT OR LEGAL GUARDIAN SIGN THIS WAIVER.
It is the responsibility of the guest to ensure this requirement is met. The Thirteenth Hour Productions LLC and Indyscreams LLC are not responsible for verifying parental/guardian consent beyond the signature provided.
PLEASE READ CAREFULLY BEFORE SIGNING
In consideration of being permitted to attend and participate in The Thirteenth Hour Haunted Attraction (“Event”), I, the undersigned, on behalf of myself, and if applicable, my minor child or ward, acknowledge and agree as follows:
1. ASSUMPTION OF RISK
I understand that The Thirteenth Hour Haunted Attraction is an immersive experience designed to be frightening, disorienting, and physically demanding. I acknowledge and voluntarily assume the risks of participating, which may include, but are not limited to:
- Environmental Effects: total darkness, strobe lights, laser effects, theatrical fog, loud or sudden noises, music, screams, startle scares, simulated explosions, temperature changes, and confined or enclosed spaces.
- Physical Conditions: uneven flooring, ramps, steps, narrow hallways, low ceilings, tight spaces, wet or damp areas, trip hazards, and outdoor terrain including gravel, dirt, and grass.
- Psychological Effects: fear, panic, disorientation, dizziness, anxiety, claustrophobia, or emotional distress from sudden scares, disturbing imagery, or violent themes.
- Contact Risks: accidental contact with walls, props, sets, costumes, or other guests due to tight spaces or darkness.
- Potential Injuries: slips, trips, falls, strains, sprains, bruises, cuts, or other minor to serious injuries caused by participation.
- Health Risks: possible aggravation of pre-existing medical conditions such as asthma, epilepsy, heart conditions, high blood pressure, pregnancy, or other conditions affected by stress, loud noises, fog, or strobe lights.
- Exposure Risks: potential exposure to communicable diseases, including colds, flu, and COVID-19.
I understand these risks are inherent and unavoidable in a haunted attraction experience. I VOLUNTARILY ACCEPT AND ASSUME FULL RESPONSIBILITY for these risks and for any injury, loss, or damage that may result from attending — for myself, and if applicable, my minor child or ward.
2. RELEASE OF LIABILITY
To the fullest extent permitted by Indiana law, I RELEASE, WAIVE, AND DISCHARGE Thirteenth Hour Productions LLC, Indyscreams LLC, and their owners, members, officers, employees, volunteers, contractors, affiliates, successors, and assigns (“Released Parties”) from ANY AND ALL CLAIMS OR LIABILITY arising from participation in the Event, INCLUDING CLAIMS BASED ON NEGLIGENCE OF THE RELEASED PARTIES. This release applies to me, and if applicable, to my minor child or ward.
3. INDEMNIFICATION
I agree to INDEMNIFY AND HOLD HARMLESS the Released Parties from any loss, liability, damage, or cost they may incur due to my actions or participation, or the actions or participation of my minor child or ward.
4. RULES OF CONDUCT
I agree (and will ensure my minor child or ward agrees) to follow all rules, including but not limited to:
- NO TOUCHING actors, props, or other guests
- NO RUNNING, smoking, open flames, or weapons
- NO ALCOHOL, drugs, or disruptive behavior
- THIS IS A NO-TOUCH ATTRACTION. Failure to comply may result in immediate removal without refund.
5. HEALTH CONDITIONS
I represent that I and, if applicable, my minor child or ward are physically able to safely participate. I understand the Event is not recommended for individuals who are pregnant, prone to seizures, have heart or respiratory conditions, or any condition aggravated by startling events.
6. MEDICAL AUTHORIZATION
In case of injury or emergency, I authorize the Released Parties to obtain medical treatment for me or, if applicable, my minor child or ward as deemed necessary. I accept responsibility for all related costs.
7. MEDIA RELEASE
I grant permission for Thirteenth Hour Productions LLC and Indyscreams LLC to use photos, video, or audio recordings of me, and if applicable, my minor child or ward, taken during the Event for promotional purposes without compensation.
8. PERSONAL PROPERTY
I understand the Event is DARK and INTENSE. I agree that the Released Parties are NOT RESPONSIBLE for lost, stolen, or damaged personal property, including cell phones, jewelry, glasses, or clothing.
9. NO REFUNDS
I acknowledge that ALL TICKET SALES ARE FINAL. Refunds will not be issued for any reason, including but not limited to: being too frightened to continue, removal for rule violations, illness, or early exit.
10. CONDUCT AND DAMAGE
I agree to act responsibly and understand that I (and, if applicable, my minor child or ward) am LIABLE for any damage caused to props, sets, equipment, or facilities due to our actions.
11. COMMUNICABLE DISEASES
I acknowledge that participation may expose me (and, if applicable, my minor child or ward) to communicable diseases, including COVID-19. I voluntarily assume all such risks.
12. GOVERNING LAW
This Waiver shall be governed by Indiana law. Any disputes shall be resolved exclusively in the courts of Marion County, Indiana.
13. SEVERABILITY
If any portion of this Waiver is found invalid, the remainder shall continue in full effect.
BY SIGNING BELOW, I ACKNOWLEDGE THAT I HAVE READ, UNDERSTAND, AND VOLUNTARILY AGREE TO THIS WAIVER FOR MYSELF, AND IF APPLICABLE, FOR MY MINOR CHILD OR WARD.
